Menus, branding, and customer data remain yours. We host and process content only to deliver and improve the Services.
Liability limits
The Services are provided as available. Our liability is limited to the extent permitted by law and your recent subscription fees.
Section 01
Eligibility and accounts
Who may use the platform and how accounts are managed.
You must be at least 18 years old and legally able to enter into a binding contract. If you use the Services on behalf of a restaurant or company, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining accurate account information and for all activity under your credentials. Notify us immediately if you suspect unauthorized access to your account.
Section 02
License and acceptable use
What you may do with the Services — and what is not allowed.
Subject to these Terms and your subscription plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal restaurant business operations. You may not sublicense, resell, reverse engineer, or copy the Services except as expressly permitted by law.
- Use the Services for unlawful, fraudulent, or harmful purposes
- Attempt to gain unauthorized access to systems, accounts, or data
- Interfere with platform stability, security, or other users' access
- Upload malware, spam, or misleading information
- Misrepresent your identity or affiliation
- Use the Services in a way that violates food safety, consumer protection, or payment regulations applicable to your business
We may suspend or terminate access if we reasonably believe you have violated these rules.
Section 03
Your content and data
Ownership, licensing, and your responsibilities for uploaded content.
You retain ownership of menus, branding, customer data, and other content you upload ("Your Content"). You grant us a license to host, process, display, and transmit Your Content solely to provide and improve the Services.
You are responsible for ensuring you have the right to use all content you submit and that it does not violate third-party rights or applicable laws.
Section 04
Subscriptions, billing, and trials
How paid plans, renewals, taxes, and promotions work.
Paid plans are billed according to the cycle selected at purchase (monthly, annual, or as otherwise stated). Fees are due in advance unless otherwise agreed. Plan features, limits, and pricing are described in your account dashboard and may change with notice as permitted by your agreement.
You are responsible for applicable taxes, duties, and government charges associated with your subscription. Failed payments may result in restricted access until the balance is resolved.
We may offer free trials or promotional pricing at our discretion. Trial terms, including duration and conversion to paid plans, will be stated at signup. We may modify or discontinue promotions at any time.
Section 05
Third-party services and availability
Integrations, uptime, and support expectations.
The Services may integrate with payment gateways, delivery tools, messaging providers, and other third-party services. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party products or outages outside our reasonable control.
We strive to keep the Services available and reliable but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, upgrades, and events beyond our control may cause temporary downtime. Support scope and response times depend on your plan and channel of contact.
Section 06
Intellectual property and confidentiality
Platform ownership and protection of shared business information.
Tibono, our logos, software, documentation, and platform design are owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or brand assets except as needed to use the Services in the ordinary course of business.
Each party agrees to protect confidential information received from the other and to use it only for purposes related to the Services, except where disclosure is required by law or with consent.
Section 07
Warranties and limitation of liability
Legal disclaimers and caps on damages.
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet every business requirement or that data will never be lost.
To the maximum extent permitted by law, Tibono and its affiliates, officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services shall not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim, or one hundred dollars (USD $100) if no fees were paid, whichever is greater.
Section 08
Indemnification and termination
When access may end and how claims are handled.
You agree to indemnify and hold harmless Tibono from claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, your violation of these Terms, or your violation of any law or third-party rights.
You may stop using the Services at any time. We may suspend or terminate your account for non-payment, breach of these Terms, or risk to the platform or other users. Upon termination, your right to access the Services ends. Provisions that by nature should survive (including payment obligations, disclaimers, limitations of liability, and indemnity) will survive termination.

Governing law and changes
Disputes, updates to these Terms, and how to reach us.
These Terms are governed by the laws applicable in the jurisdiction where Tibono operates, without regard to conflict-of-law principles. Disputes should first be raised with our support team. Where permitted by law, courts in our principal place of business shall have exclusive jurisdiction.
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes take effect constitutes acceptance of the revised Terms.
